1. Introduction

Welcome to MAISON NGUYEN. These Terms of Service govern your access to and use of maisonnguyen.ca (the “Website”) and any purchases made through it.

MAISON NGUYEN is a Toronto fine jewellery house offering rings and jewellery featuring natural diamonds, unless expressly stated otherwise.

By accessing the Website or placing an order, you agree to these Terms of Service. If you do not agree, please do not use the Website.

2. Eligibility and Use of the Website

By using this Website, you confirm that you are legally capable of entering into a binding agreement under applicable law.

You agree not to use the Website for any unlawful purpose, interfere with its operation, attempt to gain unauthorized access to its systems or submit false or misleading information.

MAISON NGUYEN reserves the right to restrict or terminate access to the Website where these Terms are violated.

3. Products and Descriptions

MAISON NGUYEN takes care to ensure that product descriptions, images, specifications and pricing are accurate and current.

Unless expressly stated otherwise, all diamonds offered by MAISON NGUYEN are natural diamonds. Product descriptions may identify relevant characteristics, including diamond shape, carat weight, colour, clarity, metal and setting details.

Natural diamonds vary in appearance and characteristics. Minor variations in colour, proportions, inclusions and other natural features are inherent to these stones and do not necessarily constitute defects.

Product photography is intended to represent each piece as accurately as possible. Appearance may vary depending on lighting, photography, display settings and individual screen characteristics.

MAISON NGUYEN reserves the right to correct errors, update product information or discontinue products without prior notice.

4. Pricing and Payment

All prices displayed on the Website are in Canadian dollars (CAD), unless otherwise indicated.

Applicable taxes and any additional charges will be displayed during checkout.

Payment must be completed using an accepted payment method before an order is processed or production begins.

For high-value purchases, MAISON NGUYEN may require additional payment verification or confirmation of customer information before accepting an order.

MAISON NGUYEN reserves the right to correct pricing errors and cancel orders affected by inaccurate pricing. Any payment collected for an order cancelled by MAISON NGUYEN will be refunded.

5. Orders and Acceptance

Submitting an order constitutes an offer to purchase the selected product.

An order confirmation email acknowledges receipt of your order but does not necessarily constitute acceptance. MAISON NGUYEN reserves the right to accept or decline an order, including where a product is unavailable, payment cannot be verified, information is inaccurate or fraudulent activity is suspected.

An order is considered accepted once MAISON NGUYEN confirms its acceptance.

Customers are responsible for reviewing all order details, including product specifications, metal selection, sizing and delivery information, before completing a purchase.

6. Production and Fulfilment

Certain pieces may be available for immediate purchase, while others are made to order.

Made-to-order pieces generally require approximately four to six weeks for production, followed by final inspection and preparation before shipment. Estimated timelines will be communicated at the time of purchase where applicable.

Production timelines are estimates and may vary depending on the specifications of the piece, material availability and other production considerations.

MAISON NGUYEN will communicate any material changes to the expected fulfilment timeline.

7. Shipping and Delivery

MAISON NGUYEN provides insured shipping for all jewellery orders within Canada.

All shipments are sent using secure, insured delivery services and require a signature upon delivery. Additional identity verification or delivery arrangements may be required for high-value orders.

Orders are generally processed Monday through Friday, excluding Canadian statutory holidays.

Customers are responsible for providing accurate and complete delivery information. MAISON NGUYEN is not responsible for delays or failed delivery resulting from inaccurate or incomplete information supplied by the customer.

Delivery timelines are estimates and may be affected by circumstances outside our control, including carrier delays, weather conditions and other logistical disruptions.

All orders are insured during shipment in accordance with the applicable insurance coverage and policy terms. Customers should contact MAISON NGUYEN promptly if a shipment arrives damaged, appears to have been tampered with or is not received as expected.

8. Returns and Cancellations

Returns

All sales are final. MAISON NGUYEN does not accept returns or exchanges on jewellery purchases.

Customers are encouraged to carefully review product descriptions, specifications, materials, diamond characteristics and sizing information before placing an order.

Nothing in this policy excludes any rights or remedies that cannot lawfully be waived under applicable consumer protection legislation.

Cancellations

Customers may request cancellation of an order within twenty-four (24) hours of placing it.

Cancellation requests must be submitted in writing through the contact information provided on the MAISON NGUYEN Website. The cancellation period begins at the time the order is placed.

Once the twenty-four-hour period has elapsed, orders cannot be cancelled, except where required by applicable law or expressly agreed to in writing by MAISON NGUYEN.

Where a cancellation is accepted, payments received will be refunded to the original payment method. Refund processing times may vary depending on the payment provider.

MAISON NGUYEN reserves the right to cancel an order in circumstances including product unavailability, pricing errors, payment verification issues or suspected fraudulent activity. Where payment has been collected for an order cancelled by MAISON NGUYEN, the amount paid will be refunded.

9. Jewellery Care

Customers are responsible for the proper care and maintenance of their jewellery after delivery.

Exposure to chemicals, impact, improper storage and everyday wear may affect the condition of jewellery over time. MAISON NGUYEN recommends appropriate care, periodic inspection and professional cleaning where necessary.

Any warranties or after-sales services expressly offered by MAISON NGUYEN will be subject to their stated terms.

10. Intellectual Property

All content on the Website, including text, photographs, product designs, graphics, logos, branding and other materials, is owned by or licensed to MAISON NGUYEN and is protected by applicable intellectual property laws.

No content may be copied, reproduced, distributed, modified or used for commercial purposes without prior written permission from MAISON NGUYEN.

The MAISON NGUYEN name, logo and associated brand elements may not be used without authorization.

11. Third-Party Services and Links

The Website may contain links to third-party websites or use third-party services, including payment processors and shipping providers.

MAISON NGUYEN is not responsible for the content, policies, security or practices of third-party websites and services. Your use of those services may be subject to their own terms and conditions.

Any disputes arising in connection with these Terms shall be subject to the jurisdiction of the courts of Ontario, subject to any mandatory rights or protections available under applicable consumer protection legislation.

MAISON NGUYEN reserves the right to amend these Terms of Service from time to time.

Updated Terms will be published on the Website with a revised “Last updated” date. Continued use of the Website following publication of changes constitutes acceptance of the revised Terms, to the extent permitted by law.
